Whenever the Commission receives an application for the installation of a
new payphone, it allows the community to have a voice through the
action of the local ANC. As with existing payphones complaints,
residents have the opportunity to challenge the installation of
a payphone in their neighborhood. The local ANC, MPD, as well as
OPC are notified of the request and allowed forty-five (45) days
to file a written opposition. If opposition is presented, a mediation
process is initiated to bring about a compromise. If no accord is
reached when the PSP is notified of the opposition, an examiner
will schedule an informal conference seeking to reach a settlement
agreement. As with complaints, negotiations can escalate to formal
hearings, appeals and Commission review.
